These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“Client”, “you”, or “your”) and Foldspans (“we”, “us”, or “our”), a Shopify app and theme development company based in Rajkot, Gujarat, India, operating the website foldspans.com.
By accessing our website, installing any of our Shopify apps, purchasing a theme, or engaging our services, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree to these Terms, do not use our Service.
1. Services
Foldspans provides the following services:
- Shopify app development and distribution via the Shopify App Store
- Shopify theme development and sales
- Shopify store setup, customization, and maintenance services
- Consulting and technical support for Shopify merchants
All services are provided as described in the relevant product listing, proposal, or service agreement. We reserve the right to modify, update, or discontinue any part of our Service at any time with reasonable notice.
2. Shopify App License
When you install a Foldspans app from the Shopify App Store, you are granted a limited, non-exclusive, non-transferable, revocable license to use the app solely for your Shopify store in accordance with these Terms and the Shopify Partner Program Policies.
You may not:
- Copy, modify, distribute, sell, or lease any part of our apps or their underlying code
- Reverse engineer or attempt to extract the source code of any app
- Use the app in a manner that violates any applicable laws or Shopify’s Terms of Service
3. App Updates and Changes
We may update, modify, or improve our apps and themes at any time to fix bugs, add features, ensure Shopify platform compatibility, or comply with Shopify’s evolving policies. We will make reasonable efforts to notify you of significant changes. Continued use of the app following an update constitutes acceptance of the updated version.
4. Pricing and Billing
Pricing for Foldspans apps and services is as described at the point of purchase. For subscription-based apps:
- Billing is handled by Shopify through the Shopify App Store billing system
- Subscription fees are charged on a recurring basis (monthly or annually, as selected)
- You may cancel your subscription at any time by uninstalling the app from your Shopify admin
- Charges are non-refundable except as described in our Refund Policy below
We reserve the right to change our pricing at any time. Existing subscribers will be notified at least 30 days before any price change takes effect.
5. Refund Policy
We offer refunds under the following conditions:
- App subscriptions: Refund requests submitted within 5 days of the initial charge will be considered, provided the request is due to a technical issue caused by our app. Refunds are not available for change-of-mind cancellations.
- Theme purchases: Due to the digital nature of theme files, all theme sales are final. Refunds are only available if the theme is materially defective and we are unable to resolve the issue within 14 days.
- Custom development services: Refund eligibility is governed by the individual project agreement or proposal.

6. Uptime and Availability
Our apps rely on third-party hosting infrastructure, including Shopify’s platform, that aims for high availability. While we strive for reliable service, we do not guarantee 100% uptime. Scheduled maintenance, Shopify platform updates, or factors outside our control may cause temporary unavailability. We shall not be liable for any losses arising from service interruptions.
7. Intellectual Property
All content on foldspans.com and within our apps and themes — including but not limited to code, designs, graphics, logos, text, and documentation — is the exclusive property of Foldspans and is protected by applicable intellectual property laws.
You are granted a limited license to use our apps and themes as described in these Terms. Nothing in these Terms transfers any ownership of our intellectual property to you.
8. Data and Privacy
Your use of our Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Service, you consent to the data practices described in our Privacy Policy.
When you install a Foldspans Shopify app, you grant us permission to access the store data required for app functionality as disclosed in the app listing and Privacy Policy. We handle all data in compliance with applicable privacy laws including GDPR and CCPA.
9. User Obligations
You agree that you will:
- Provide accurate and truthful information when contacting us or purchasing our products
- Use our apps and services only for lawful purposes and in compliance with Shopify’s Terms of Service
- Not use our apps to transmit spam, malware, or any harmful content
- Not attempt to gain unauthorized access to our systems or other users’ data
- Notify us promptly if you become aware of any unauthorized use of your account or our systems
10. Limitation of Liability
To the maximum extent permitted by applicable law, Foldspans shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising out of or in connection with your use of our Service, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or relating to these Terms or our Service shall not exceed the total amount paid by you to Foldspans in the 12 months preceding the claim.
11. Disclaimer of Warranties
Our Service is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that our Service will be error-free, uninterrupted, or free of viruses or other harmful components.
12. Third-Party Services
Our apps and website may integrate with or link to third-party services (including Shopify, payment processors, and analytics providers). These services have their own terms and privacy policies, and we are not responsible for their practices. Your use of third-party services is at your own risk.
13. Our Rights
We reserve the right to:
- Modify or discontinue any part of our Service at any time
- Refuse service to anyone for any reason at any time
- Provide our services to your competitors without exclusivity obligations
- Update these Terms at any time, with the updated version effective upon posting
14. Termination
Either party may terminate the service relationship at any time. You may terminate by uninstalling our app(s) and ceasing use of our Service. We may terminate or suspend your access if you violate these Terms, misuse our Service, or if required by law. Upon termination, your license to use our apps ends immediately.
15. Governing Law
These Terms and any disputes arising from or related to them shall be governed by and construed in accordance with the laws of Rajkot, Gujarat, India. You and Foldspans submit to the non-exclusive jurisdiction of the courts of Rajkot, Gujarat, India for resolution of any such disputes.
16. Changes to These Terms
We may revise these Terms from time to time. When we do, we will update the “Last Updated” date at the top of this page. Continued use of our Service after any changes constitutes your acceptance of the new Terms. We encourage you to review this page periodically.
